A pregnant lady was under antenatal care of the gynaecologist. Complications developed during delivery. A boy was delivered suffering from cerebral palsy.

The patient was aghast and furious at the doctor. She sued her and made following allegations:
  1. The gynaecologist was informed about lesser foetal movement in the womb few days before the delivery, but she ignored it
  2. Umbilical cord was wrapped around baby’s neck during delivery resulting in convulsions and asphyxia
  3. Baby is ‘normal’ was recorded in the discharge slip, which proves that either the doctors were not proficient or they had ulterior motives to record an incorrect fact
  4. CTG tracing was not done after the baby was administered oxytocin
  5. While the child has grown, he behaves like a toddler. He is completely dependent and cannot be left unattended
